Welcome to Oguya. These Terms of Service govern your access to and use of the Oguya app discovery platform and its related services (the â€œServiceâ€). By accessing or using the Service, you agree to be bound by these Terms and any policies referenced herein. If you do not agree, please discontinue use of the Service.

1. Acceptance of Terms

By using the Service, you enter into a binding agreement with Oguya. You warrant that you are of legal age to form a contract in your jurisdiction and that you will comply with these Terms in their entirety. We reserve the right to suspend or terminate your account for any violation of these Terms or applicable law.

2. Changes to Terms

Oguya may revise these Terms from time to time. We will provide notice of material changes and update the â€œEffective dateâ€ above. Continued use of the Service after such changes constitutes acceptance of the revised Terms.

3. Description of the Service

Oguya is a platform designed to help users discover mobile applications. We curate listings and direct users to apps through external distribution channels. Oguya does not host, publish, or maintain the apps themselves on this site. All app content and availability are governed by the respective distribution platforms (for example, Google Play) and their terms of service.

Oguya does not guarantee the continued availability, performance, or safety of any app linked through the Service. App availability and terms are determined solely by the external platform hosting the app.

4. Intellectual Property

All intellectual property rights in the Service, including the Oguya name, logo, design, and underlying software, are owned by Oguya or licensed to us. You may access and use the Service for personal, non-commercial purposes in accordance with these Terms. You may not reproduce, modify, distribute, display, perform, or create derivative works from any portion of the Service without our prior written consent. All rights not expressly granted herein are reserved.

5. Third-Party Links and External Services

The Service includes links to apps and other external services hosted by third parties on platforms such as Google Play. These links are provided for convenience and informational purposes only. We do not control or endorse these third-party services and do not guarantee their content, safety, performance, or availability. Accessing and using such third-party services is at your own risk, and you should review the applicable terms of service and privacy policies of those third parties.

6. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, Oguya disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and title. Oguya does not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components. Any content or data downloaded through the Service is at your own risk.

7. Limitation of Liability

In no event will Oguya or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service. Our aggregate liability shall not exceed the greater of (a) the amount paid, if any, for the use of the Service in the twelve months preceding the claim, or (b) USD 100. The foregoing limitations apply to the maximum extent permitted by law.

10. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the jurisdiction designated by Oguya, without regard to its conflict of laws principles. Any disputes arising under these Terms will be resolved in the courts located within that jurisdiction, subject to applicable mandatory arbitration requirements where available.

11. Termination

We may suspend or terminate your access to the Service at our sole discretion for conduct that violates these Terms or for other reasons, with or without notice. Upon termination, your right to use the Service ceases immediately, and you must discontinue all use and destroy any downloaded content obtained through the Service.
